Terms of service
These Terms of Service (“Terms”) govern your use of the Tutel AI website, app and related services (the “Services”). They form a binding agreement between you (as an individual or on behalf of an organization) and Tutel AI (“Tutel,” “we,” “us”). By creating an account or using the Services, you agree to these Terms. If you don’t agree, don’t use the Services.
Eligibility
- You must be at least 18 years old and able to enter into a binding contract.
- You must give accurate information when you register and keep it up to date.
- If you use the Services for an organization, you confirm you have authority to accept these Terms for it.
Your account
- Keep your password private. You’re responsible for activity under your account.
- Tell us right away at support@tutel.ai if you think someone has accessed your account without permission.
- Accounts are for one person. Don’t share your sign-in with others; teams should add seats instead.
- We will never ask for your password by email or phone.
Beta, plans and billing
The free beta
The Services are currently offered as a free beta. During the beta, we don’t charge for the Services and don’t require a payment method. Beta features may change, and we may set reasonable usage limits, such as monthly practice minutes, to keep the Services available for everyone.
When you sign up, you may choose the plan you expect to use after the beta. We’ll email you before the beta ends. If you’ve added a payment method by then, your account will move to your chosen plan and billing will begin. If you haven’t, your account will be paused, not charged, until you choose a plan or delete your account.
Paid plans
- Fees: plans are billed monthly or yearly in advance, at the prices shown on our pricing page when you subscribe.
- Renewal: paid subscriptions renew automatically until you cancel.
- Price changes: we’ll give you at least 30 days’ notice before a price increase takes effect.
- Cancellation: you can cancel at any time. Cancellation takes effect at the end of the current billing period.
- Refunds: if you’re not satisfied, ask for a refund within 14 days of your first paid charge and we’ll refund it. Other fees are non-refundable except where the law requires otherwise.
- Payments: payments are processed by our payment processor under its own terms.
Acceptable use
Use the Services only for lawful purposes and in line with these Terms. Don’t:
- break any law or infringe anyone’s rights;
- upload malicious code, or try to gain unauthorized access to our systems or other users’ data;
- interfere with the Services, get around usage limits, or overload them with automated requests;
- scrape, reverse engineer or copy the Services, or use them to build a competing product;
- upload content that you don’t have the right to share, including recordings of people who haven’t agreed to be recorded where their consent is required;
- use the Services to harass, abuse, impersonate or harm anyone.
We may suspend or close accounts that break these rules.
Your content
You own the content you create or upload, such as profile details, prep sheets, practice transcripts and uploaded files. You give us permission to store, process and display that content as needed to provide the Services to you and your team, and to use aggregated or de-identified information to improve the Services. We don’t share your individual practice content publicly, and we don’t use it to train AI models.
Our intellectual property
The Services, including the software, scoring framework, design, text and logos, belong to Tutel and are protected by law. We give you a limited, non-exclusive, non-transferable license to use the Services for your own professional development or your organization’s internal training while these Terms are in effect. This license doesn’t let you copy, modify, resell or distribute the Services.
AI-generated content
The Services use AI to play buyers and to score and coach your performance. AI output can be inaccurate or incomplete. Scores and coaching are for practice and educational purposes; they aren’t professional, legal, employment or psychological advice, and we don’t guarantee any particular sales result. Use your own judgment, and please tell us when something looks wrong.
Privacy
Our privacy policy explains how we collect and use personal information. It’s part of these Terms.
Third-party services
We rely on third-party providers to run the Services, as listed in our privacy policy. We aren’t responsible for third-party websites or services that you choose to use or that we link to.
Disclaimers
The Services are provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement, and any warranty that the Services will be uninterrupted or error-free. This is especially true during the beta.
Limitation of liability
To the fullest extent the law allows, Tutel will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or business opportunities. Our total liability for any claim relating to the Services is limited to the amount you paid us in the 12 months before the claim.
Some places don’t allow these limits, so they may not apply to you.
Indemnification
You agree to defend and indemnify Tutel and its team against claims and costs arising from your misuse of the Services, your content, or your breach of these Terms or the law.
Ending this agreement
- You can stop using the Services and delete your account at any time from your profile.
- We may suspend or end your access if you break these Terms, if payment fails once paid plans begin, if the law requires it, or to protect the Services or other users. Where reasonable, we’ll give notice first.
- If we end your account for reasons other than a breach, you can ask us for a copy of your data within 30 days.
- Sections that by their nature should survive termination, such as ownership, disclaimers, liability limits and dispute resolution, will survive.
Disputes
Governing law
These Terms are governed by the laws of the State of Oregon, United States, without regard to conflict-of-law rules.
Talk to us first
Before filing a claim, contact us at support@tutel.ai and give us 30 days to try to resolve it informally.
Arbitration and class action waiver
If we can’t resolve a dispute informally, it will be resolved by binding individual arbitration administered by the American Arbitration Association under its applicable rules, except that either of us may bring an individual claim in small claims court, and either of us may ask a court to stop infringement of intellectual property. Claims may be brought only individually, not as a plaintiff or class member in any class or representative proceeding.
You may opt out of arbitration within 30 days of first accepting these Terms by emailing support@tutel.ai with “Arbitration opt-out” in the subject line.
General
- Changes: if we make material changes to these Terms, we’ll email account holders and update the date above at least 30 days before they take effect. Using the Services after that means you accept the changes.
- Assignment: you may not transfer these Terms without our written consent. We may transfer them as part of a merger, acquisition or sale of assets.
- Entire agreement: these Terms and our privacy policy are the whole agreement between you and Tutel about the Services.
- Severability and waiver: if part of these Terms can’t be enforced, the rest still applies. Not enforcing a right isn’t a waiver of it.
